Herald Benefits program terms and conditions:
Your participation in the Herald Benefits Program constitutes your acceptance of the following terms and conditions:
1. THE HERALD BENEFITS PROGRAM
1.1 The Program is operated by Fairfax. Any Subscriber who is a natural person and whose subscription is issued in their name may participate. Corporate subscribers are not eligible to participate in the Program.
1.2 As a Subscriber, you are allocated a unique subscriber number which will be used to identify you as a participant in the Program.
1.3 Fairfax reserves the right to make changes to these terms and conditions from time to time and without notice. The most up to date copy of the terms and conditions will appear on the Herald Benefits website (www.heraldbenefits.com.au).
1.4 Fairfax reserves the right to cancel or suspend the Program at any time and without notice.
1.5 Your eligibility to participate in the Program may be terminated or suspended by Fairfax without notice if:
(a) You do not comply with these terms and conditions;
(b) You cease to be a Subscriber; or
(c) Fairfax ceases to operate the Program for any reason.
2. THE BENEFITS
2.1 The benefits available under the Program are listed from time to time on the Herald Benefits website and in other promotional material issued by us from time to time. All information is accurate at the time of publication but may change without notice.
2.2 All benefits are subject to availability and any other specific terms and conditions which may be imposed by Program Partners. These may be communicated by us on behalf of the Program Partner or by the Program Partner directly. Unless otherwise stated no benefit may be used in conjunction with any other offer.
2.3 The benefits are available to Subscribers only and cannot be sold, transferred, assigned or otherwise dealt with except with the consent of Fairfax and the relevant Program Partner.
2.4 The benefits must be taken as stated and no compensation will be payable if you fail to take up or use the benefit as stated. You will not be entitled to any compensation if Fairfax elects to terminate or suspend the Program.
2.5 To claim a benefit, you must indicate to the Program Partner that you are a Subscriber and that you wish to obtain a benefit under the Program as follows:
(a) If you contact the Partner by telephone you must notify the Partner at the outset of the first telephone conversation that you are a Subscriber, that you are requesting the relevant benefit and thereafter provide your Subscriber account number as required by the Partner; or
(b) In a web-based transaction you may be asked to enter your Subscriber number or any other method of identification that may be required by the Program Partner.
2.6 We take all reasonable care to ensure that information we publish in relation to the Program is accurate but do not accept any liability relating to information provided by third parties. All descriptions of benefits we publish are based on information supplied by Program Partners.
3. PROGRAM PARTNERS AND TRANSACTIONS
3.1 Under the Program, we arrange for Program Partners to offer certain benefits to Subscribers. Program Partners are not the agents of Fairfax and have no authority, express or implied, to bind Fairfax or to make any representations, warranties or statements on our behalf.
3.2 We are not a party to any transactions entered into between a Subscriber and a Program Partner.
3.3 As a result, we are not liable in any way for:
(a) any use of your subscription details by a person without your consent;
(b) any failure by you to notify a Program Partner that you are seeking a benefit under the Program when purchasing goods or services;
(c) a Program Partner not offering or making available a benefit for any reason;
(d) a failure by a Program Partner to comply with the terms of any transaction you enter into with the Program Partner;
(e) the suspension and/or termination of the Program.
3.4 We make no warranties, whether express or implied and whether arising under legislation or otherwise, nor shall we be liable in any way in respect of the condition, suitability, quality, fitness or safety of any goods, services or benefits supplied under the Program to you by a Program Partner.
3.5 Any liability relating to the payment of tax, including GST, which arises from your participation in the Program by virtue of your purchasing any goods or services from a Program Partner, is your responsibility.
4. PRIVACY
5.1 Information on how we handle your personal information is explained in our Privacy Policy Statement available on the Herald Benefits website.
5.2 Program Partners will not have access to your name and address unless you agree to provide it to them. We take no responsibility for any information you elect to give to any Program Partner.
5. DEFINITIONS
In these terms and conditions:
“Fairfax”, "we" or "us" means Fairfax Media Publications Pty Limited, publisher of The Sydney Morning Herald and The Sun-Herald.
"Subscriber" or "You" means a person who is a subscriber to The Sydney Morning Herald and The Sun-Herald and who is eligible to participate in the Program.
"Program" means the "Herald Benefits" Program to which these terms and conditions apply.
"Program Partner" or "Partner" means a person or organisation which has agreed to offer certain benefits to Subscribers. These benefits may include discounts, upgrades or other offers or benefits as determined by Fairfax or the Partner.
“Trial subscription” means a subscription which is taken at a discounted rate over a short period of time in the aim of trialling a subscription.
A “Subscription” means a standard fully paid Sydney Morning Herald or Sun-Herald subscription taken up directly with Fairfax. It will consist of a 26 week, 52 week or Direct Debit payment option only.

- Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.
- Entry is only open to residents of NSW and ACT. However, employees and their immediate families of Fairfax Media Publications Pty Ltd, Fairfax Media Ltd, and their associated agencies and companies are not eligible to enter.
- The competition commences on Wednesday, 28th July 2010 at 08:00 (AEDT) and concludes on Thursday, 26th August 2010 at 23:59 (AEST).
- Participants must be subscribers of The Sydney Morning Herald and/or The Sun-Herald, this subscription must be held directly with The Sydney Morning Herald and/or The Sun-Herald, and not with a third-party. This subscription must be valid and current at the date of judging.
- To enter, participants must log onto heraldbenefits.com.au and register their details including (but not limited to) name, address, postcode, phone number and subscriber number. The promoter reserves the right to disqualify any entrant that does not provide a valid subscriber number.
Entries must also include an answer to the question “Why do you want to sail on a whale-watching cruise?” in 25 words or less.
- Entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter.
- Incomprehensible and incomplete entries will be deemed invalid.
- Entrants may only enter once per subscriber number.
- The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity (including proof of subscription ownership) in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
- The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. This includes, but not limited, to entrants and households using multiple email addresses, postal addresses, PO Box addresses or SIM cards to register single or multiple entries. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
- Entries must be received by 23:59 (AEST) on Thursday, 26th August 2010. The time of entry will in each case be the time the entry is received by the Promoters database. The Promoter accepts no responsibility for any late, lost or misdirected entries including entries not received by the Promoter or delays in the delivery of the entry due to technical disruptions, network congestion or for any other reason.
- The cost of accessing the promotional website will be dependant on the entrant’s individual Internet Service Provider.
- The will be one (1) winner. The winner will receive a whale watching weekend for two (2) valued up to $2,150 (incl. GST). The prize includes:
- Return economy flights for two (2) from Sydney to the Gold Coast (does not include checked baggage)
- Two (2) nights double or twin share accommodation at Vibe Hotel, Gold Coast
- Buffet breakfast for two (2) included during the stay
- A whale watching cruise for two (2)
- Total prize pool value is $2,150 (incl. GST).
- Prizes cannot be transferred, refunded, exchanged, replaced and cannot be redeemed for cash.
- The winner and their companion are responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, taxes (including departure taxes), airline charges for checked baggage, energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
- The winner and travelling companion must travel at the same time, must depart from Sydney and are responsible for transport from their residence to Sydney for flight departure.
- Government taxes are an additional cost to the winners and their travelling companions and are required prior to ticketing.
- If the winner/s is under the age of 18 as at the date of the draw, an adult must accompany the minor in the participation of the prize.
- The winner must advise Wotif.com of their travel dates by 30th August 2010 and the prize must be taken by 20th September 2010 and is subject to hotel and flight availability. The prize is not available during peak times such as public holidays and school holidays (if applicable) and cannot be changed once the booking has been made.
- Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline.
- A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges. Once accommodation vouchers are issued they are non-changeable.
- It is the traveller’s personal responsibility to ensure that they have valid documentation, including but not limited to valid identification, which meet the requirements of the government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the traveller/s.
- If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.
- The promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
- Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.
- By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.
- In consideration for the Promoter awarding the prize to the winner, the winner hereby assigns to the Promoter all right, title and interest in and to all copyright in any material created pursuant to the winner’s participation in any aspect of the prize (Works). The winner acknowledges that the Promoter is free to use the Works and to exercise its rights in relation thereto and the winner will not be entitled to any fee for such use.
- In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with Fairfax Media Publications Pty Ltd or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.
- In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
- Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
- Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
- One (1) major winner will be chosen from all the entrants who has entered the competition over the duration of the promotional period by a judging panel at the Promoters office commencing Friday, 27th August 2010 at 11:00 (AEDT). All decisions of the Promoter are final and no discussions or correspondence will be entered into.
- The criteria for judging will be based on the most original and creative answers. There will be one (1) winner only.
- The winners will be notified within 2 days of judging. The winners will be notified of their prize in writing.
- Prizes will only be awarded to the person associated with the subscriber number used to submit their entry.
- Should an entrant’s contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.
- The major prize must be claimed by Sunday, 29th August 2010 and if the prize remains unallocated or unclaimed, then the prize will be forfeited and cash will not be awarded in lieu of the major prize. The prize will be re-allocated to the entrant that has submitted the entry which best meets the judging criteria after excluding the entrant that has failed to claim the prize.
- The promoter’s decision is final and the promoter will not enter into correspondence regarding the Competition result.
- It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.
- It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
- In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any directions given under State Regulation.
- The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, network failure, theft or destruction or unauthorised access to or alteration of entries.
- The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
- The Promoter and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
- If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any direction given under State Regulation.
- All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion but no further use of this information will be made without prior consent.
- All opt-in entries will be entered into a database and Wotif.com may use the entrant’s names, addresses and telephone numbers for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant. By opting-in, entrants confirm that they allow their details to be used for this purpose. If entrants no longer consent to their details being used for future marketing purposes, the entrant should contact Wotif.com on their details set out below. Any request to update, modify or delete the entrant’s details should be directed to Wotif.com. - Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter.

Runner-up Prize Runner-up winners will each receive an Icon DVD pack valued at $138.65 (incl. GST) each. Total runner-up prize pool is valued at $1,386.50 (incl. GST).
